Attorney General Challenges Court Rulling

 

The Attorney General has moved to court to challenge the High Court rulings on inclusion of Kadhis Courts in the Constitution as unconstitutional.

The AG who claims the ruling was in itself unconstitutional has filed a notice of his intention to appeal the decision.

 

He will later be expected to file the appeal and get hearing dates.

 

The landmark ruling has thrown the country into disarray as the debate on the constitution continues to widen the rift between the Yes and the No teams threatening to tear the country apart.

 

The High Court on Monday ruled that the inclusion of the courts contravened the principle of the separation of State and Religion and as such should not form part of the Judiciary in the Constitution.

 

Elsewhere, Council of Imams and Preachers of Kenya Organising Secretary Sheikh Mohamed Khalifa, Supreme Council of Kenya Muslims Chairman Abdulghafur El-Busaidy and Kenya Muslim National Advisory Council Chairman Sheikh Ngao they are yet to decide the next course of action following the ruling.
