Seven judge bench to hear BBI case

The President of the Court of Appeal Justice Daniel Musinga has constituted a seven-judge bench to hear the Building Bridges Initiative (BBI) case.

The judges picked to hear the case set to take place from June 29th to July 2nd  include Presiding Judge Daniel Musinga, justices Roselyn Nambuye, Hannah Okwengu, Patrick Kiage, Gatembu Kairu, Fatuma Sichale, and Francis Tuiyott.

High profile personalities including President Uhuru Kenyatta, the BBI National Secretariat, and the Independent Electoral and Boundaries Commission (IEBC) are involved in the case which seeks to challenge the High Court ruling that declared the bid to amend the constitution through the BBI as unconstitutional.

In the deceleration, the High Court ruled that the President does not have authority under the Constitution to initiate changes to the Constitution and that a constitutional amendment can only be initiated by the President through the Attorney General in Parliament through a Parliamentary initiative.
